Reasons for Refusal of CAT application
Summary of the reasons by Tayside NHS Board for refusal of
Community Asset Transfer request:
1. Risks and issues identified to do with the deliverability, viability and sustainability of the Business Plan proposals. Significant shortfall in funding required to bring the site and buildings up to standard including sources to meet ongoing running costs.
2. Additional benefits to the community proposed by BHG do not offer sufficient benefit to offset the discount requested.
3. The offer price by BHG too low as against the market value of the site. The loss would affect the Board’s investment in patient care.
4. If the project failed the Board could not be protected legally.
We are going to appeal which has to be done within 20 days of receiving the decision. We are in the process of drafting the appeal with the help of experts in the subject.
